These General Terms and Conditions (the “Agreement”) govern the purchase, use, and management of gift certificates and gift checks (collectively referred to as “Cards”) issued by Gouverneur Inc. (“Gouverneur”). By purchasing, accepting, or using a Card, you agree to be bound by these terms. If you do not agree to these terms, you should not purchase or use the Card.
About Your Card
The Cards are issued by Gouverneur Inc. and its business partners: OTL Gouverneur, Boefish, and PAŪS Spa Experience. Gouverneur Inc. is the sole legal debtor regarding the use of the Cards. Gift certificates can be purchased at participating retailers, and promotional gift checks are distributed as part of loyalty programs, rewards, or promotions. Goods purchased with a Card are subject to the merchant’s return policy.
Balance Information and Requests
You can check the balance of your gift certificate online, but please note that the balance shown is an estimate. The balance is generally updated immediately after a purchase, but delays may occur. The balance of promotional gift checks cannot be verified online.
Using Your Card
You can use up to five gift certificates or gift checks per transaction.
If the purchase amount exceeds the balance on the Card or gift check, you will need to complete the payment with another payment method.
If your purchase is less than the balance of the Card, the remaining balance can be used for a future purchase. In the case of a promotional gift check used for a purchase less than the balance, the remaining balance will be nullified.
Items purchased with a gift certificate and returned will be subject to the merchant’s return policy. If a refund is applicable, it will be issued as a credit to a gift certificate unless the law requires a cash refund.
Purchase Limits and Restrictions
You can purchase up to a maximum of five gift certificates of $1,000 CAD each, for a total not exceeding $1,000 CAD per transaction. If you wish to purchase more Cards or a total amount exceeding $1,000 CAD, please contact us directly. Gift certificates cannot be used to purchase other Cards or redeemed for cash unless required by law.
Card Expiration
Gift certificates do not have an expiration date in accordance with applicable law. However, promotional gift checks may have an expiration date depending on the specific promotion. You must refer to the specific terms of each promotional gift check for its expiration date.
Fees
No service, inactivity, or any other fees will be applied to your Card unless required by law.
Exchange and Use
Cards can only be used to purchase products and services at participating retailers in Canada. They have no monetary value and cannot be exchanged for cash, unless required by law. Additionally, they cannot be used to purchase another Card.
No Refunds
Cards are not refundable for cash, unless required by law. If you are not satisfied with a purchase made using a Card, you must refer to the merchant’s return policy.
Lost, Stolen, or Damaged Cards
In the event of a lost, stolen, or damaged Card, it is important to report it immediately. However, the value of the Card will not be replaced. Gouverneur Inc. disclaims any responsibility for the loss or theft of a Card.
Limitation of Liability
Gouverneur Inc. and its business partners disclaim any express or implied liability regarding the Cards, including, but not limited to, any implied warranty of merchantability or fitness for a particular purpose. In the event of a defect in the Card, your sole remedy will be its replacement.
Some jurisdictions’ laws may not permit the exclusion or limitation of certain warranties, and some remedies may be modified based on local laws.
Changes to the Agreement
Gouverneur Inc. reserves the right to modify these terms and conditions at any time, at its sole discretion. Any changes will be communicated by any reasonable means, including, but not limited to, posting the revised version on our website. You will be notified of significant changes, such as by email or through updates to our policy on this page.
Fraud Prevention
Gouverneur Inc. reserves the right to refuse to honor any Card it suspects has been obtained fraudulently. If you believe a Card has been used fraudulently, you must immediately contact our customer service to notify us.
